Unexplored Ladakh “Mountain Bike Rental Terms and Conditions”

1. Introduction This document outlines the terms and conditions for renting mountain bikes. By renting a bike, you agree to abide by all the terms and conditions listed below. Please read this agreement carefully.

2. Eligibility for Renting

  • Renters must present a valid government-issued photo ID (e.g., passport, driver’s license, or national ID card) at the time of rental.
  • Renters must be at least 18 years of age to rent a bike.
  • Minors under 18 may rent bikes only if a parent or legal guardian completes and signs the rental agreement.
  • The rental company reserves the right to refuse rental to individuals deemed unfit to operate the equipment safely (e.g., under the influence of alcohol or drugs).

3. Rental Period

  • The rental period begins when the bike is handed over to the renter and ends when the bike is returned to the designated location.
  • Bikes must be returned by the agreed-upon time and date.
  • Late returns will incur additional charges as specified in the rental agreement (e.g., hourly or daily rates for extended use).

4. Payments and Deposits

  • Rental Fee: The full rental fee is due at the time of booking or when the bike is collected.
  • Security Deposit: A refundable security deposit may be required for each bike rented. This deposit will be held to cover potential damages, loss, or late return fees.
  • The deposit will be refunded upon the safe return of the bike in its original condition.
  • Acceptable payment methods include cash, credit cards, debit cards, or digital payment platforms (if available).

5. Inspection and Condition of Equipment

  • All bikes are inspected and maintained regularly to ensure they are in safe working condition.
  • Renters must inspect the bike at the time of pickup and report any noticeable defects or issues.
  • By accepting the bike, the renter agrees that it is in satisfactory condition and free of defects.

6. Proper Use of Equipment

  • Bikes must be used solely for their intended purpose—mountain biking—and not for racing, stunts, or commercial activities unless explicitly agreed upon.
  • Renters must comply with all local traffic laws, mountain biking regulations, and safety guidelines.
  • Helmets are provided and strongly recommended to minimize the risk of injury. Renters may be required to wear helmets in certain jurisdictions.
  • Renters are prohibited from modifying the bike or attaching unauthorized accessories.

7. Liability for Damage, Loss, or Theft

  • Renters are fully responsible for any damage, loss, or theft of the bike during the rental period.
  • Repair or replacement costs will be deducted from the security deposit or charged separately if the deposit is insufficient.
  • If the bike is stolen, the renter must immediately file a police report and provide a copy to the rental company. The renter will be liable for the full replacement cost.

8. Renter’s Responsibilities

  • Renters must ensure the bike is stored securely when not in use.
  • Renters must not lend the bike to another person without prior written consent from the rental company.
  • Renters must notify the rental company immediately in the event of mechanical failure or an accident involving the bike.

9. Cancellations and Refunds

  • Standard Cancellation Policy:
    • Cancellations made more than 24 hours before the rental period will receive a full refund.
    • Cancellations made within 24 hours of the rental period may be subject to a cancellation fee.
  • Weather-Related Refunds: In cases of severe weather, rescheduling or refunds may be offered at the company’s discretion.

10. Safety and Acknowledgment of Risk

  • Mountain biking is an inherently risky activity, and renters assume all associated risks.
  • The rental company is not responsible for injuries, accidents, or damages to personal property incurred during the rental period.
  • Renters are encouraged to use safety equipment such as helmets, gloves, and knee pads.

11. Insurance (Optional)

  • Renters may have the option to purchase insurance coverage for damages or theft.
  • If insurance is not purchased, renters will be fully liable for any costs arising from damage or theft.

12. Return Policy

  • Bikes must be returned to the agreed-upon location by the end of the rental period.
  • Bikes returned in a dirty or unreasonably unclean state may incur additional cleaning fees.
  • Failure to return the bike on time without prior notification will result in additional charges.

13. Prohibited Activities Bikes must not be used:

  • In unsafe weather conditions (e.g., heavy rain, snow, or extreme winds).
  • In areas explicitly restricted or marked as off-limits.
  • Under the influence of alcohol, drugs, or any other substances that impair judgment.

14. Amendments to Terms and Conditions

  • The rental company reserves the right to amend these terms and conditions at any time without prior notice.
  • Any changes will be communicated to renters at the time of booking.

15. Legal Jurisdiction

  • This agreement is governed by the laws of the region where the rental company is located.
  • Any disputes arising from this agreement will be resolved in the local courts of the jurisdiction.

16. Acknowledgment and Agreement By signing the rental agreement or accepting the bike, you confirm that you:

  • Have read and understood these terms and conditions.
  • Agree to comply with all the requirements and responsibilities outlined herein.
